Excess BAC DMV Revocations in Colorado DUI Cases

After being charged with DUI, there are two ways in which a person’s license may be revoked for excess BAC.  First, a person may be revoked for excess BAC by a DMV hearing officer after a DMV hearing.  Secondly, a person may be revoked for excess BAC if he or she fails to make a timely request for a DMV hearing after submitting a chemical test in excess of .08.  In either scenario, the lengths of DMV revocations are the same.  However, the exact length of revocation will depend upon the driver’s driving history, and whether he or she has been previously revoked pursuant to a DUI, DWAI, or refusal.

A person with a BAC above .08, with no prior revocations, faces a 9 month revocation.

A person with a BAC above .08, with one prior revocation, faces a one year revocation.

A person with a BAC above .08, with two or more prior revocations, faces a two year revocation.

In certain circumstances, an individual with a BAC in excess of .08 may reinstate early with an Interlock ignition breathalyzer device, in addition to meeting other requirements. The length of time the person must continue maintain such a device in his or her vehicle will depend upon multiple factors.
