What Are the Criminal Consequences for a 2nd DWAI?

Upon conviction for a second lifetime alcohol or drug-related driving offense, in any state, an individual is subject to the following possible sentence requirements:

  • Between 10 days to one year in jail, at the judge’s discretion
  • A fine between $600-$1500, at the judge’s discretion
  • Between 48 and 120 hours of community service
  • A Mothers Against Drunk Driving “Victim Impact Panel”
  • At least two years of probation
  • Monitored sobriety
  • Substance abuse education and therapy
